Summary: The relationship between cities and water is as old as vital and is confused with the history of mankind. Ever since the first human settlements until today’s cities, water resources represent an important factor for the occupation of a territory and its relevance is unquestionable for the maintenance of human life and prosperity of cities. In the despite of that, Brazilian urbanization process resulted in socio and environmental problems mainly those related to the occupation of urban rivers, such as floods and suppression of riparian vegetation. Part of this situation is the result of the misconception of abundance and the idea of infinity of natural resources. On the other hand, one must also consider the legal obstacles and the difficulties of supervision by the public agencies. This research aims to analyze urban and environmental situation of the Guaranhuns watershed, in Vila Velha/ES, through legislation on the Areas of Permanent Preservation (APP), in order to identify challenges and possibilities for its preservation, given the importance of this area in the urban, economic and environmental dynamics of the municipality of Vila Velha. The methodology included: investigation of the relationship established between natural and urban environment, focusing on urban and environmental conflicts that occurred, especially floods, through a bibliographical review; description and analysis of the empirical object through maps, iconography, bibliographic sources and field visits; comparison between the current situation of the empirical object and legislation regarding APPs and water bodies, considering also the draft revision of the Municipal Master Plan of Vila Velha, in progress. The main results were: mapping of the urban and environmental aspects of the study area; systematization of the urban and environmental legislation in the three spheres of government; and the analysis of this legislation in the Guaranhuns Watershed. It was verified two forms of degradation in the study area: environmental quality, perceived without difficulties, and another more subjective form, related to urban and social processes. It was also verified that the legislation in Vila Velha presents some inconsistencies regarding natural resources, especially water bodies and green areas. It was concluded that legislation plays an important role in the articulation between preservation of the natural environment and urban development, contributing to the construction of fairer, more equitable and enjoyable cities. Vila Velha has the legal instruments capable of positively change the relationship of its population and urban rivers and wetlands, mainly due to their role in
mitigating the impacts of floods. However, it is necessary to align discourse and practice, so that the coexistence of society and natural environment be a reflection of the ideals desired in the paper. Finally, despite all the problems faced in Vila Velha, related to water bodies and green areas, it was observed a growing concern with natural resources in the Guaranhuns Watershed.
